How to Expunge Your Record

Use the Forms Listed in the Download Section.The following instructions are for filing in Bakersfield. If you are filing in the Lamont, Ridgecrest, Shafter, Mojave or Delano other instructions are coming soon.

You may be required to use additional forms depending on your situation. Forms can be obtained from your local courts website. Each County has its own procedure for the dismissal processes. The instruction below are focused to provide help for those filing in Kern County.

Match up the form numbers at the top right corner of the pages with the numbers on the samples. Use the Sample Petition to help you fill out the CR 180 and the Sample Order to help you fill out the CR 181.

If you can, filing in person is generally easier. Follow the instructions fro filling the type of Expungement you have ( Felony or Misdemeanor)

If you are out of town and you need to file by mail, keep in mind that you will still need to appear for a hearing. If you are unable to appear for a hearing, you may contact the probation department about representing you. They will charge and it will likely take longer.

To file by mail, you will need a Notice of Hearing.

PROCEDURE FOR FILING CRIMINAL MISDEMEANOR MOTIONS
  1. Fill out paperwork completely. Use Form CR180 & CR181. Pick your own court date that is AT LEAST 15 calendar days from the day you plan to file the paperwork on a Tuesday, Wednesday, or Thursday, at 8:30 a.m. in Div. L&M. It can be more than 15 days, just not before the 15th day.
  2. Make two additional copies of each paper.
  3. Take all copies to Misdemeanor department on the 1st floor of The courthouse at 1215 Truxtun Ave. and have your date confirmed by court staff.
  4. Take all copies to the District Attorney’s Office on the 4th Floor at 1215 Truxtun Ave. They will stamp them all and keep one copy.
  5. Take the stamped original and copy, and file them with the Criminal Misdemeanor Department on the first floor of the courthouse at 1215 Truxtun Ave. They will confirm your copy and mail it to you. Make sure your address is correct.
  6. Show up on your date for court. The courthouse at 1215 Truxtun Ave. is often very busy in the morning. There is generally a line outside the courthouse, while people wait to go through security. Make sure you give yourself enough time to find parking and go through security.
PROCEDURE FOR FILING CRIMINAL FELONY MOTIONS
  1. Fill out paperwork completely. Pick your own court date that is AT LEAST 15 calendar days from the day you plan to file the paperwork on a Monday, Tuesday, Wednesday, or Thursday, at 8:30 a.m. in Div. CC. It can be more than 15 days, just not before the 15th day.
  2. Make three additional copies of each paper.
  3. Take all copies to the Kern County District Attorney’s Office on the 4th Floor at, 1415 Truxtun Ave. They will stamp them all and keep one copy.
  4. Take the stamped original and copy, and file them with the Felony Criminal Department on the first floor of the courthouse at 1415 Truxtun Ave. They will confirm your copy and mail it to you. Make sure your address is correct.
  5. Show up on your date for court. The courthouse at 1415 Truxtun Ave. is often very busy in the morning. There is generally a line outside the courthouse, while people wait to go through security. Make sure you give yourself enough time to find parking and go through security.
