Civil Harassment

You can file a Civil Harassment Restraining Order when someone is harassing you and you would like a court order to make them stop

YOU DO NOT FILE A CIVIL HARASSMENT RESTRAINING ORDER AGAINST:

Boyfriend/Girlfriend
Ex-Boyfriend/Ex-Girlfriend
Grandparent
Parent
Brother/Sister
Son/Daughter
If the person you are wanting a restraining order against is not someone you could ask for a Civil Harassment Restraining Order against, or if you are unsure, you may need to complete a Domestic Violence Restraining Order. If you are uncertain, call the Kern County Law Library at 868-5320.

TO BEGIN YOUR CIVIL HARASSMENT RESTRAINING ORDER:
To start, you will need to fill out these forms (Download the Civil Harassment Package):

CH109
CH110
CLETS001
Erase the Sample information on each form and replace it with your information.
And put them together in that order. File them at the Civil Department. Once your papers are returned to you, it is up to you to get it served to the police and the other party.

TO SERVE:
Someone other than you, 18 or older needs to give a copy to whoever is being served and sign a proof of service. You must then turn the proof of service in to the court. This generally needs to be turned in at least 5 days before the hearing.

BE AWARE it usually takes a couple of days to receive your paperwork back from the court and immediate orders are not always granted. Read through the papers you get back from the court carefully to find out what orders there are until the hearing.
